Terms and ConditionsThese terms and conditions apply to all contracts between you and us. Interpretation "We", "us", "our", means G. H. Smith & Son. "You", "your" means the person ordering products under these terms and conditions. "Working days" means all days other than Saturdays, Sundays, and Public Holidays. "Product" means the product or products you have ordered from us. Before Placing an Order Product Availability Our availability information is updated regularly, but it is possible that in some instances a title may become unavailable between updates. We will make every reasonable effort to deliver the products you have ordered within the delivery timeframe applicable at the time of order. If this is not possible, we will notify you and at your option agree a different delivery period or provide a substitute product of equivalent value. Alternatively, you may cancel your order in which case, if your payment card has been debited, we will refund you the purchase price. Our policy is to cancel orders if we have been unable to supply books within 60 days, or any other items within 45 days, with the exception of products that have not yet been released or that are reported as reprinting. On some occasions, we are required by the card issuer to perform additional security checks on the payment card, which can delay the order until the card has been authorised. The delivery times given are approximate and delays can sometimes occur. You will receive an email as soon as your order is dispatched. All delivery times quoted on this website are estimates only, these times are based on working days. You will become the owner of the products you have ordered when the products have been delivered to you Price & Postage Prices shown on this site include VAT, where and to the extent that VAT is required to be applied to the product under UK VAT law. Confirming the Order In placing this order you confirm that you are aware of any age restrictions on these products and assert that you are old enough to purchase them. Please note that all orders are made subject to our Standard Terms and Conditions of Supply. These are available on our Help pages. See in particular the sections on Price Changes and Disclaimer. The Contract Between Us After you have confirmed your order we will send an email to you summarising each order you have placed. When your order has been packaged and is about to be posted to you we will debit your payment card with the total cost of your order. Contracts formed between G. H. Smith & Son and users as a result of using this site shall be governed in all respects by English law and all such users hereby submit to the non-exclusive jurisdiction of the English courts. Completion of the contract between you and us will take place on dispatch to you of the products ordered. This will be deemed to be our acceptance of your offer and to have been effectively communicated to you. This is to be interpreted and enforced with the laws of England, in its entirety and will be subject to the jurisdiction of the English courts. This disclaimer does not affect your statutory rights as a consumer. Please note that some of our processes are manual and errors can arise. We carry out frequent checks to detect any errors. If they do occur, we will act immediately to minimise inconvenience and disappointment that may be caused. We reserve the right to cancel any order where obvious errors in pricing or product description have occurred. Restrictions Details of any delivery restrictions are noted in the details/description for the products concerned. In some instances we may decline to deliver parcels to PO addresses. We will contact you if we consider the PO address to be a problem. Payment Details We accept payment by Visa, MasterCard, Switch, Maestro, Delta and American Express. All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion. Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds in order to fulfil the transaction. No payment is debited from your card during this pre-authorisation check. Your card will only be charged upon dispatch of the items in your order. Your card will not be debited for items in your order which have not been dispatched. Changing Payment Card Details Our system holds no credit card numbers. Once an Order Has Been Placed Your Cancellation Rights It is advisable that you cancel any unwanted orders via email to info@ghsmith.com or by contacting our account directly on + 44 (0)1347 821329 (24hrs), before they are invoiced and dispatched. Requests for cancellations sent via email may not be actioned for 48 hours in extremely busy periods, which may result in the order being dispatched. You may cancel your order before the delivery or within seven working days after the date of delivery by contacting us either by email at info@ghsmith.com or by telephoning + 44 (0)1347 821329 (24hrs), quoting your order number. We will refund you the cost of your unwanted products and our delivery charges. If you cancel your order within seven working days after the date of delivery, you must return the unwanted products to us unused and in their original packaging at your risk and at your cost within thirty days of delivery. Provided you return the unwanted products unused and in the original packaging within thirty days of delivery, we will credit your payment card with the cost of the unwanted product and our delivery charges within thirty days of the date of cancellation. Price Increases G. H. Smith & Son reserve the right to change prices listed without notice. All orders for products are subject to availability and G. H. Smith & Son reserves the right to refuse to supply to any individual or company. Pricing Errors Although we make every effort to ensure the prices on the website are correct, mistakes may sometimes be made. If we discover a mistake in the price of the products you have ordered, we will tell you and give you the option of either reconfirming your order at the correct price or cancelling your order. If we are unable to contact you or we receive no reply from you, we will cancel your order. If your order is cancelled and you have already paid for the products you will receive a full refund. Consolidating Orders If items that will usually be dispatched within 24 hours are ordered with items that are usually dispatched in 2 - 3 days the former be may held in order to be dispatched with the latter. If you would prefer that these items are sent separately you should order the items separately, however additional postage costs will be incurred. Items not available for this consolidation process will be sent out as soon as they are received and any additional postage costs will be paid by G. H. Smith & Son. Data Protection Your details remain private and confidential and will not be divulged to any third party. Payment Card Security Policy Your credit card details are not recorded and we have no access to them, as we use a secure payment facility. Limitation of Liability - We will not be liable to you:- For any loss of profit, administrative inconvenience, disappointment, or indirect or consequential loss or damage arising out of any problem in relation to the products you ordered which was not within our reasonable contemplation as a probable result of a breach of contract on our part at the time that our contract with you was concluded. Where performance of any obligations to you is prevented, frustrated or impeded by any circumstance or caused beyond our reasonable control. Severability If any part of these terms and conditions is found to be unenforceable as a matter of law, the enforceability of any other part of these terms and conditions will not be affected. Governing Law These terms and conditions and any contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction over any disputes between us. Statutory Rights - These terms and conditions are in addition to your statutory rights as a consumer which remain unaffected. Upon Receipt Of An Order Seller Liability The seller does not accept liability for shortages in quantities delivered unless the buyer notifies the seller of any claim of short delivery of the goods within two working days of delivery. In such circumstances the seller's liability shall be restricted to making good the shortfall. Making Returns - Products may be returned: In person to G. H. Smith & Son. At the time of return you must show your invoice as proof that you purchased the products from us. By post in accordance with the following procedure:- Repackage the products securely and send the products together with the reason for return, the invoice number, your e-mail address or telephone number and instructions as to whether you would like a refund or a replacement. You will find the Returns address on the paperwork that arrives with your order. All unwanted goods must be in resalable condition, in their original packaging and with any security seals still intact. Returns by post are made at your risk. We recommend that you use an insured registered mail service as returns not received by us cannot be credited to you. Your return delivery charges will be refunded by us if the return is made in accordance with the conditions mentioned above. Refunds will be credited to your payment card. Refunds will not be paid in cash. Goods 'Lost In Transit' For deliveries to any UK address please allow 7-28 working days from the date of dispatch. For overseas addresses please allow up to 28 days. If this time elapses and the goods have not arrived, you should contact your local post office to verify that no items are being held for you pending delivery. If your post office has confirmed that no packages are being held, please contact us via email info@ghsmith.com or Tel +44 (0)1347 821329. If you wish replacement goods to be sent, you must contact us within 28 days of your order being dispatched. We will not send replacement items unless you have checked your local post office first. Complaints - We aim to provide outstanding customer service.
